Labor Law Dismissal
Partner Stuart Glass and Senior Counsel Ronald Berman successfully obtained summary judgment dismissing a wrongful death claim alleging violations of the New York Labor Law. While defeating multiple competing motions seeking the same relief, FP secured a decisive ruling that the plaintiff failed to establish the essential elements of a Labor Law claim. The court agreed with our position that our client exercised no direction or control over the plaintiff’s work, that the work at issue constituted maintenance rather than construction, and that there was no competent proof as to how the accident occurred.
